Automatic Collection of Information:

A misconception about cookies is that they function like a software program such as spyware. A cookie is quite simply a small text file that can do nothing by itself. Cookies may create problems when they capture personal and/or account information that is then accessed by malicious spyware programs. Data Collection and Purpose Specification:
- Kindle Publishing does not collect personal data without a user's knowledge.
- Data will never be sold nor will it ever be given to anyone not directly representative of Kindle Publishing.
- Data will never be accessed by anyone other than authorized licensed school representatives or an authorized Kindle Publishing employee.
- Data may be accessed by an authorized Kindle Publishing employee in the following cases:
- During a technical support call
- During a workshop or training
- During certain phases of product and/or content development. Data used for this purpose is strictly limited to scoring and grade level and is used soley for the purpose of validation of testing items.
Data Longevity on Kindle Publishing Servers After Subscription Expiration:
Online delivery of HeartBeeps Assessments is done by annually renewable subscription. If a licensee allows a subscription to lapse, associated data will be securely archived on Kindle Publishing servers for a maximum of 90 days. This grace period allows the licensing site extra time to renew a subscription. After 90 days, all data previously generated by the licensing site will be permanently deleted.
Data may be deleted prior to 90 days upon written request from the licensee.
Student Privacy:
- Student data will be stored on Kindle Publishing servers. Such data may include:
- - First name and last name
- - User ID
- - Password
- - Grade level
- - Date of birth (optional)
- - Middle initial (optional)
- - Gender (optional)
- - Designators such as: Title I, II, II, ESL, Free lunch (all optional)
- - Two discretionary data fields (both optional)
- Student data is used soley for the purpose of reporting.
- Because it is possible to include student information in a printed report or text file that may be electronically transmitted or imported and merged with other data in another software program, AND because Kindle Publishing cannot be responsible for data entered by a licensee, sites are advised to adhere to the following safety precautions:
- Never use a student's social security number as the student ID.
- Never enter discriminatory or defamatory information in discretionary fields.
- Never enter information that conflicts with HIPPA, COPPA, or any applicable privacy laws or mandates set forth by the governing body of your site.
- When generating a printed report or exporting report data in a file, always follow applicable privacy laws when storing, using, or electronically transmitting sensitive data.
- Scores generated by students are stored on Kindle servers. Access to scoring data is restricted to the student generating them, licensees, or a Kindle Publishing employee during tech support, product training, or product/content development.
Disclosure and Visitor Choice:
- Kindle Publishing does not disclose a licensee's data to anyone unaffiliated with Kindle Publishing.
Confidentiality / Security:
- Kindle Publishing has implemented security policies, rules, and technical measures to protect data from:
- Unauthorized access
- Improper use or disclosure
- Unauthorized modification
- Unlawful destruction or accidental loss
- Inadvertant user deletion of data
- All Kindle Publishing employees who have access to and are associated with the processing of personal data are obliged to respect the confidentiality of a licensee's data.
- Kindle Publishing ensures that a licensee's data will not be disclosed to state institutions and authorities except if required by law or other regulation.
Access to Data:
No data is stored on Kindle Publishing servers other than data that is provided by you. A licensee may review any associated data as long as the license is active.
Privacy Compliance:
Kindle Publishing is voluntarily committed to a Self Assessment procedure that is in accordance with the Federal Trade Commission (FTC)'s Children's Online Privacy Protection Rule, as well as additional guidelines and recommendations set forth by the FTC and COPPA.
Kindle Publishing also strives to protect licensee data by implementing privacy policies included in currently proposed legislation such as Sec. 302 "Requirements for a Personal Data Privacy and Security Program" within the proposed bill S. 495: Personal Data Privacy and Security Act of 2007.
In the event Kindle Publishing should change its privacy policy, this Privacy Statement will be updated and available on the website before affecting any Kindle Publishing customer.
